Name Image Likeness (NIL) Information

What is NIL?
Name, Image, and Likeness (NIL) refers to a student-athlete's ability to receive compensation for the use of their name, image, or likeness consistent with NCAA Division III legislation, Texas law, and University of Mary Hardin-Baylor policies.
Student-athletes may engage in NIL activities while maintaining their NCAA eligibility, provided all applicable rules and institutional requirements are followed.

Permissible NIL Activities
Student-athletes may:
  • Receive compensation for promoting a business, product, or service.
  • Use their NIL to promote their own business ventures.
  • Receive compensation for appearances, autograph signings, camps, clinics, speaking engagements, or other promotional activities.
  • Utilize professional service providers or agents for NIL-related activities, provided representation is limited to NIL matters and not athletic participation.
Prohibited Activities
Student-athletes may not:
  • Receive compensation without providing a legitimate service or deliverable.
  • Receive compensation contingent upon enrollment or continued enrollment at UMHB.
  • Receive compensation based on athletic participation, athletic performance, or achievement.
  • Enter into NIL agreements that function as recruiting inducements or pay-for-play arrangements.
  • Use UMHB logos, trademarks, uniforms, facilities, or institutional branding without prior authorization.
  • Endorse products or services prohibited by NCAA rules, institutional policy, or applicable law.
NIL Reporting Requirements
Student-athletes must disclose proposed NIL activities through the University's designated compliance process before entering into an NIL agreement.
Prior to signing an agreement, student-athletes should:
  1. Submit the proposed NIL activity through Teamworks.
  2. Provide any requested documentation.
  3. Resolve any identified conflicts with institutional agreements or policies.
  4. Maintain copies of all NIL agreements and supporting documentation.
Questions regarding NIL activities should be directed to the Athletics Compliance Office before entering into an agreement.

NIL and Boosters
Student-athletes and prospective student-athletes may enter into NIL agreements with businesses and individuals, including athletics supporters, provided the arrangement complies with NCAA legislation, Texas law, and University policies.
NIL agreements may not:
  • Be used as recruiting inducements.
  • Be contingent upon enrollment at UMHB.
  • Constitute pay-for-play or compensation for athletic performance.
Student-athletes are encouraged to consult with the Athletics Compliance Office before entering into any NIL agreement involving a booster or athletics supporter.
